BY USING COOLSTONE SERVICES YOU AGREE TO THE FOLLOWING TERMS AND ANY APPLICABLE THIRD-PARTY TERMS.

1. Acceptable Usage

1A. Service Damage

1B. Follow US & California Laws

These Terms shall be governed by and construed in accordance with the laws of California and the United States of America. You may not use any of our services in any unlawful, illegal, fraudulent, or harmful manner, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

1C. Transmission of Illicit Software

You must not use our services to copy, store, host, transmit, send, use, publish, or distribute any material which consists of (or is linked to) any spyware, computer viruses worm, keystroke logger, rootkit, or other malicious software.

1D. Automated Data Collection

You must not conduct any systematic or automated data collection activities (including scraping, data mining, data extraction, and harvesting) on or in relation to our services without our express written consent.

1E. Redistribution

You may not copy, modify, redistribute, sell, lease, or sublicense our software or services (excluding open-sourced projects). You also may not reverse engineer or decompile our software or services or assist anyone unless you have express written consent or applicable law permits it.

1F. Liabilities

In no event will we be liable to you or any third party for any damages, including any lost profits, lost savings, or other incidental, consequential, or special damages arising out of the use or inability to use our services, even if we have been advised of the possibility of such damages.

1G. Accounts

You are responsible for maintaining the confidentiality of your login information. All activities that occur under your account are your responsibility. You will be held accountable for losses due to someone else using your account.

2. Third-Party Terms of Use

If you access a service from a third-party provider, their terms and privacy policy apply accordingly.

3. User-Generated Content

User-generated content refers to any content or material created, submitted, or published by users of a website or service, such as comments, posts, reviews, files, or other contributions. "Offensive" content is content that violates section 3B.

3A. Immunity

Section 230 of the Communications Decency Act (CDA) provides immunity from liability for providers and users of online services for third-party content. Our services are covered under this provision, so we are not responsible for user-generated content posted on our platforms. You understand that you are solely responsible for the content you submit, and you indemnify and hold us harmless from any claims, damages, or liabilities arising out of or related to your submitted content.

3B. Content

By submitting content, you agree not to submit any content that is offensive, defamatory, obscene, threatening, or otherwise violates the rights of any third party. You also agree not to submit any content infringing upon the copyright, trademark, or other intellectual property rights. If you encounter any content you believe violates our terms of service or is otherwise inappropriate, please report it to us immediately.

3C. Licensing

By submitting any content, such as text, images, videos, or any other material, to our platform, you acknowledge and agree that you retain ownership of the rights to your content. However, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with our services. To revoke this right, permanently delete your content from our services.

3D. Removal

You acknowledge and agree that we have the right, but not the obligation, to monitor, review, and remove any user-generated content that violates our community guidelines, terms of service, or applicable laws. Additionally, we reserve the right to modify, delete, or disable any user-generated content that we believe, in our sole discretion, violates our terms of service or poses a risk to the security, integrity, or reputation of our platform.

3E. Feedback

By submitting feedback, you grant us the perpetual and irreversible right to use your feedback without restrictions, attribution, or compensation.

3F. Third-Party

Third-Party Content

We are not responsible for the content distributed by one of our services from third-party services. You shall not be held accountable for offensive content outside of your reasonable control.

Our services may contain links to third-party websites. We are not responsible for these websites and encourage you to review the terms and privacy policies of any third-party websites you visit.

4. Force Majeure

We are not liable for any delay or failure of any of our Services because of any cause beyond our reasonable control. This includes but is not limited to, the list below.

  • Natural disasters, such as hurricanes, earthquakes, and floods

  • Pandemics, epidemics, or widespread illness

  • Wars, riots, terrorist/cyber attacks, or civil unrest

  • Government actions, such as embargoes or trade restrictions

5. Class Action Waiver
